Workinjuryistheabbreviationofworkinjury,alsoknownasoccupationalinjury(occupationalinjuries),whichreferstothedirectactionofexternalfactorsduringtheproductionprocess.Causessuddenaccidentaldamagetobodytissues,suchascasualtiesandacutechemicalpoisoningcausedbyoccupationalaccidents.
Thedefinitionof"workinjury"inthe1921ConventionadoptedbytheInternationalLabourConferenceis:anaccidentdirectlyorindirectlycausedbyworkisaworkinjury.
The48thInternationalLabourConferencein1964alsostipulatedthatwork-relatedinjurycompensationshouldincludeoccupationaldiseasesandcommutingtrafficaccidents.Therefore,thecurrentinternationallystandardizeddefinitionof"work-relatedinjuries"includestwoaspects,namely,accidentinjuriesandoccupationaldiseaseinjuriescausedbyworkthatoccurduringtheworkprocess.Occupationaldiseasesrefertodiseasescausedbyexposuretodust,radioactivematerials,andothertoxicandharmfulsubstancesinoccupationalactivitiesofworkersinenterprises,publicinstitutions,andindividualeconomicorganizations.
ScopeofRecognition
TrialMeasuresforEnterpriseWorkers’WorkInjuryInsurance
The“TrialMeasuresforEnterpriseWorkers’WorkInjuryInsurance”issuedbytheformerMinistryofLaborin1996regulatesthescopeofworkinjuryClearlystipulated.Employeeswhoareinjured,disabled,orkilledduetooneofthefollowingcircumstancesshallbedeemedaswork-relatedinjuries,andthescopeis:1.Engageindailyproduction,workoftheunitorworktemporarilydesignatedbythepersoninchargeoftheunit,Inanemergency,althoughithasnotbeendesignatedbythepersoninchargeoftheunit,itisdirectlyrelatedtothemajorinterestsoftheunit.
2.Withthearrangementorconsentofthepersoninchargeoftheunit,engagedinscientificexperiments,inventionsandtechnologicalimprovementsrelatedtotheunit.
3.Occupationaldiseasescausedbyexposuretooccupationalharmfulfactorsintheproductionworkenvironment.
4.Intheproductionandworkinghoursandarea,accidentalinjurycausedbyunsafefactors,ordeathduetosuddenillnessduetoworkstress,oralllossoflaborafterthefirstrescuetreatment.
5.Personalinjurycausedbyperformingduties.
6.Engaginginrescue,disasterrelief,andlife-savingactivitiesthatsafeguardthenational,socialandpublicinterests.
7.Theoldinjuryrecurredafteraservicemanwasdisabledduetoworkorwarafterreturningtoworkinanenterprise.
8.Duringbusinesstrips,duetowork,trafficaccidentsorotheraccidentscausedinjuryordisappearance,ordeathduetosuddenillness,oralllostlaborafterthefirstrescuetreatmentof.
9.Accidentsonthewaytoandfromgetoffworkonotherreasonablerouteswithinareasonabletimearework-relatedinjuries.
(1)Onthewaytoandfromworkonareasonableroutetoandfromworkandresidence,habitualresidence,andunitdormitorywithinareasonabletime;
(2)WithinareasonabletimeOnthecommutetoandfromworkonareasonableroutebetweentheplaceofworkandtheplaceofresidenceofthespouse,parents,andchildren;
(3)Engageinactivitiesthatarenecessaryfordailyworkandlife,andcommutetoandfromworkatareasonabletimeandrouteOntheway;
(4)Onthewaytoandfromworkonotherreasonablerouteswithinareasonabletime.(Injuriesonthewaytoandfromgetoffworkrefertotrafficaccidentsthatshouldhaveoccurredonareasonabletimeandrouteandarenotthemainresponsibilityoftheperson.)

WorkInjuryInsuranceRegulations
Relevantregulationsonworkinjuryclassification
Article14EmployeeshaveOneofthefollowingsituationsshallbedeemedasawork-relatedinjury:
(1)Injuredbyaccidentduetoworkduringworkinghoursandworkplace;
(2)BeforeandafterworkinghoursIntheworkplace,engagedinpreparatoryorfinishingworkrelatedtotheworkandsufferedaccidentalinjury;
(3)Duringtheworkinghoursandworkplace,thepersonisinjuredbyviolenceorotheraccidentsduetotheperformanceofworkduties;
(4)Thosewhosufferfromoccupationaldiseases;
(5)Thosewhoareinjuredduetoworkorhaveanaccidentwhiletheyareawayfromwork;theirwhereaboutsareunknown;
(6))Onthewaytoandfromwork,areinjuredbytrafficaccidentsorurbanrailtransit,passengerferry,ortrainaccidentsthatarenotthemainresponsibilityoftheperson;
(7)Othersituationsthatshouldberecognizedaswork-relatedinjuriesaccordingtolawsandadministrativeregulations.
Article15Ifanemployeehasoneofthefollowingcircumstances,itshallbedeemedasawork-relatedinjury:
(1)SuddenillnessduringworkinghoursandpositionsDiesordieswithin48hoursaftertherescueisineffective;
(2)Injuredduringrescueanddisasterreliefactivitiestosafeguardthenationalinterestandpublicinterest;
(3)Workers’principlesServedinthearmyandwasdisabledduetowarorduty-relatedinjuries,hasobtainedarevolutionarydisabledsoldiercertificate,andtheoldinjurieshaverecurredafterarrivingattheemployer.
Iftheemployeehasthesituationinitem(1)anditem(2)oftheprecedingparagraph,heshallenjoywork-relatedinjuryinsurancebenefitsinaccordancewiththerelevantprovisionsoftheseregulations;Therelevantprovisionsoftheregulationsenjoywork-relatedinjuryinsurancebenefitsinadditiontotheone-timedisabilitysubsidy.
Article16IfanemployeemeetstheprovisionsofArticle14andArticle15ofthisRegulation,buthasoneofthefollowingcircumstances,itshallnotbedeemedasaworkinjuryordeemedtobeaworkinjury:
(1)Deliberatelycommittingacrime;
(2)Drunkortakingdrugs;
(3)Self-harmorsuicide.

Oldworkinjury
By2012,oldworkinjurylacksanaccurateconceptualdefinition.Inthepracticeofworkinjuryinsurance,itisgenerallyunderstoodthatitwilloccurinOctober1996.Workinjuriesbeforetheimplementationofthe"TrialMeasuresforEnterpriseWorkers’WorkInjuryInsurance"onJanuary1arecollectivelyreferredtoas"oldworkinjuries."Infact,therearedeviationsinthisunderstanding.Theauthorbelievesthatitispreciselythistermthathasledtotheclassificationof"new"and"old"workinjuries,whichhasledtodisputesovertheapplicationofwork-relatedinjurypolicies.Thestandarddefinitionof"oldwork-relatedinjuries"shouldbe"work-relatedinjurieswhoarenotcoveredbywork-relatedinjuryinsurance."ThismeansthatnotonlybeforeOctober1,1996,butalsoafterthe"WorkInjuryInsuranceRegulations"cameintoeffectonJanuary1,2004,becausetheemployerdidnotparticipateintheworkinjuryinsurance,peoplewhowereunabletoreceiverelevantbenefitsfromtheworkinjuryinsurancefundafteraworkinjuryoccurred,Canbecalled"oldworkinjury".

Workinjuryistheabbreviationofwork-relatedinjurycomparedtonon-work-relatedinjury.Inthepast,duetoinstitutionalreasons,cadresandemployeesofstateagenciesandinstitutionsinourcountrywereinjuredanddisabledduetoworkreasons.Thecurrent"WorkInjuryInsuranceRegulations"hasbeenappliedtoemployeesofordinaryinstitutions.PublicinjuriesonlyexistinpublicservantsofstateagenciesandrefertotheCivilServantsLaw.Forthepersonnelofpublicinstitutionsandsocialorganizationsundermanagement,work-relatedinjuriesarestillapplicabletootherstaffmemberswhohaveformedlaborrelationswithstateagencies,publicinstitutionsandsocialorganizationsmanagedwithreferencetotheCivilServiceLaw.

Thedifferencebetweenwork-relatedinjuriesandwork-relatedinjuriesis:
Thesubjectandtherelationshipbetweenthemaredifferent.Work-relatedinjuriesoccurinlaborrelations,thatis,betweenemployersandworkers.Publicinjuriesoccurbetweenstateagencies,publicinstitutionsandsocialorganizationsmanagedwithreferencetotheCivilServiceLaw,andtheirstaff.Thisrelationshipisnotalaborrelationship,withAdministrativeattributes.
Thebasisfordeterminingbenefitsisdifferent.Workinjurybenefitsaredeterminedbyworkinjuryinsuranceregulationsandlocaladministrativeregulations.Thetreatmentofpublicinjuryshallbeformulatedbythepersonnel,laborandsocialsecuritydepartmentsinconjunctionwiththefinancialdepartments.
Thebenefitsofwhethertoparticipateinworkinjuryinsurancearedifferent.Work-relatedinjuriescanparticipateinwork-relatedinjuryinsuranceandenjoywork-relatedinjuryinsurancebenefits.Workinjuryinsuranceisnotallowedforwork-relatedinjuries,andyoucannotenjoywork-relatedinjuryinsurancebenefits,butenjoytherelevantwork-relatedinjurybenefits.

Differentdisputeresolutionmethods.Disputesarisingfromwork-relatedinjurytreatmentmayberesolvedinlabordisputearbitration,applicationforadministrativereconsideration,administrativelitigation,andcivillitigationaccordingtothespecificcircumstances.Anyonewhodisagreeswiththetreatmentofaunit’spublicinjurycanonlypassapersonneldisputearbitrationawardfirst,andthosewhoaredissatisfiedwiththeawardcanfileacivillawsuitinthepeople’scourt.
Conditions
TheMinistryofHumanResourcesandSocialSecuritypointedoutthataninjuryonthewaytoandfromworkmustberecognizedasaworkinjury,andthefollowingconditionsmustbemetatthesametime:1.Onthewaytoandfromgetoffwork;2.ThereasonfortheinjuryisAtrafficaccidentoccurred;3.Inthedeterminationofresponsibilityforthetrafficaccident,Iamnotthemainresponsibility.Therefore,ifyoufallandfallonasnowyroad,youwillbeinjuredbythefall.Althoughithappenedonyourwaytoandfromgetoffwork,youhavenotbeeninjuredbyatrafficaccidentthatisnotyourmainresponsibility,andyoucannotbeconsideredasawork-relatedinjury.

Responsibilitydetermination

Applicationprocess
1.Applicationsubjectforwork-relatedinjuryidentification
(1)Theemployerappliesforwork-relatedinjuryidentification:WhenanemployeeisinjuredinanaccidentorisinjuredinaccordancewiththeprovisionsoftheOccupationalDiseasePreventionandControlLawWhenthediagnosisoridentificationisanoccupationaldisease,theemployershallapplyforworkinjuryidentificationinaccordancewiththelaw,whichisitslegalobligation.
(2)Theinjuredemployeeorhisimmediatefamilymembers,tradeunionorganizationsapplyforwork-relatedinjurycertification:Wheretheemployerdoesnotapplyforwork-relatedinjurycertificationwithintheprescribedtimelimit,theinjuredemployeesortheirimmediatefamilymembers,laborunionorganizationsYoucandirectlyapplyforworkinjurycertificationinaccordancewiththelaw.Accordingly,suchanapplicationmustmeetaprerequisite,thatis,theemployerhasnotfiledanapplicationforworkinjurydeterminationwithintheprescribedtimelimit.Assoonasanon-employeeisinjuredbyanaccidentorisdiagnosedandidentifiedasanoccupationaldiseaseinaccordancewiththeprovisionsoftheOccupationalDiseasePreventionandControlLaw,theinjuredemployeeorhisimmediatefamilymembersortradeunionorganizationscandirectlyapplyforworkinjurycertification.Inthiscase,thedirectapplicationforworkinjurydeterminationisacivilrightratherthananobligationfortheinjuredemployeeorhisimmediatefamilymembers.Atthesametime,thelawauthorizestradeunionorganizationstoalsohavetherighttoapplyforworkinjuryidentificationtoprotectthelegitimaterightsandinterestsofinjuredemployees.
2.Jurisdictionforwork-relatedinjuryidentification
(1)Socialinsuranceadministrativedepartment.Specifically,anapplicationforworkinjurycertificationshouldbesubmittedtothesocialinsuranceadministrativedepartmentoftheoverallplanningarea.
(2)Inaccordancewithregulations,anapplicationforwork-relatedinjuryidentificationshallbesubmittedtotheprovincialsocialinsuranceadministrativedepartment,anditshallbesubmittedtothemunicipalsocialinsuranceadministrativedepartmentofthedistrictedcitywheretheemployerislocatedinaccordancewiththeprincipleofterritoriality.
3.Timelimitforapplicationforidentification
(1)Timelimitforemployerstoapplyforwork-relatedinjuryidentification:30days,countingfromthedaytheaccidentinjuryoccursorthedaywhentheinjuryisdiagnosedoridentifiedasanoccupationaldisease.Incaseofspecialcircumstances,thetimelimitforapplicationcanbeextendedappropriatelyafterreportingtothesocialinsuranceadministrativedepartmentforapproval.Asforwhatis"specialcircumstances"andwhatis"appropriateextension",thesocialinsuranceadministrativedepartmentshalldetermineanddecideatitsdiscretion.Duringtheabove-mentionedperiod,iftheemployerhasnotappliedforwork-relatedinjurycertification,theinjuredemployeeorhisimmediatefamilymembersortradeunionorganizationsmayapplyforwork-relatedinjurycertificationdirectlybeforetheyapplyforwork-relatedinjurycertification.
(2)Thetimelimitfortheinjuredemployee,hisimmediatefamilymembers,orthetradeunionorganizationtoapplyforwork-relatedinjuryidentification:1year,countingfromthedaytheaccidentinjuryoccursorthedaytheoccupationaldiseaseisdiagnosedoridentified.Thisperiodisthede-exclusionperiod.
4.SubmissionofWorkInjuryCertificationMaterials
(1)Fillinthe"WorkInjuryCertificationApplicationForm"uniformlyformulatedbytheMinistryofHumanResourcesandSocialSecurity.
(2)Acopyofthetextofthelaborcontractorothervalidproofoftheestablishmentoflaborrelations.
(3)Post-injurydiagnosiscertificateoroccupationaldiseasediagnosiscertificate(oroccupationaldiseasediagnosiscertificate)issuedbyamedicalinstitution.
Ifthematerialsprovidedbytheapplicantareincomplete,thesocialinsuranceadministrativedepartmentshallnotifytheapplicantofallthematerialsthatneedtobesupplementedandcorrectedonthespotorinwritingwithin15workingdays.
5.Acceptanceorrejection
(1)Acceptanceconditions:
①Theapplicationmaterialsarecomplete
②ItbelongstothesocialinsuranceadministrationDepartmentaljurisdiction
③Thedeadlineforacceptancehasnotyetpassed
④Theapplicantiseligible.
Theabovefourconditionsmustbemetatthesametime,otherwise,theapplicationwillnotbeaccepted.
Ifthesocialinsuranceadministrativedepartmentacceptsit,itshallnotifytheapplicantinwritingandexplainthereasons.
(2)Inadmissibility:Theapplicantshouldbenotifiedinwritingandexplainthereasons.
6.Investigationandverificationofevidence
(1)Thesocialinsuranceadministrativedepartmentcaninvestigateandverifytheevidenceprovidedasneeded.
(2)Theinvestigationandverificationofthesocialinsuranceadministrativedepartmentshallbeconductedbytwoormorepersonneltogether,andthecertificatesforperformingofficialdutiesshallbepresented.
(3)Real-timeinvestigationandverification,exerciseofpowersinaccordancewiththelaw,andfulfillstatutoryconfidentialityobligations.
(4)Accordingtoworkneeds,entrustsocialinsuranceadministrativedepartmentsorrelevantdepartmentsinothercoordinatingareastoinvestigateandverify.
(5)Burdenofproof:
①Inprinciple,whoeverclaimsappliesandwhoprovidesevidence.Otherwise,itshallbeartheunfavorableconsequencesoftheinabilitytoprovideevidence.
②Inthecasewhereanemployeeorhisimmediatefamilyconsidersittobeawork-relatedinjuryandtheemployerdoesnotconsiderittobeawork-relatedinjury,theemployershallbeartheburdenofproof.Iftheemployerrefusestoprovideevidence,thesocialinsuranceadministrativedepartmentmaymakeaconclusiononworkinjurydeterminationbasedontheevidenceprovidedbytheinjuredemployee.
7.Work-relatedinjurydeterminationdecision
(1)Thedeterminationdecisionincludesthedeterminationdecisionofawork-relatedinjuryordeemedwork-relatedinjuryandthedeterminationdecisionthatisnotawork-relatedinjuryornotdeemedawork-relatedinjury.
(2)Thesocialinsuranceadministrativedepartmentshallmakeawork-relatedinjuryidentificationdecisionwithin60daysfromthedateofapplicationfortheidentificationofascienceandengineeringinjury.However,ifthefactsareclearandtherelationshipbetweenrightsandobligationsisclear,adecisionshouldbemadewithin15days.
(3)Thework-relatedinjurydeterminationdecisionshallspecifytherequireditemsinaccordancewiththelaw.
(4)Thework-relatedinjurydeterminationdecisionshallbestampedwiththespecialsealofthesocialinsuranceadministrativedepartmentforwork-relatedinjurydetermination.
8.Deliveryandcopying
(1)Thesocialinsuranceadministrativedepartmentshallsendtheworkinjurydeterminationdecisiontotheworkinjurywithin20workingdaysfromthedatewhentheworkinjurydeterminationdecisionismade.Identifytheapplicant,theinjuredemployee(orhisimmediatefamily)andtheemployer,andsendacopytothesocialinsuranceagency.
(2)Theserviceoflegaldocumentsforthedeterminationofwork-relatedinjuriesshallbecarriedoutinaccordancewiththeprovisionsoftheCivilProcedureLaw.
9.Reconsiderationorlitigation
Wheretheemployee,hisimmediatefamilymembers,ortheemployerdisagreeswiththerejectiondecisionortheworkinjurydeterminationdecision,theymayapplyforadministrativereconsiderationorfileanadministrativelawsuitinaccordancewiththelaw.
10.Dataarchiving
Aftertheendoftheworkinjurydetermination,thesocialinsuranceadministrativedepartmentshallkeeptherelevantmaterialsfortheworkinjurydeterminationforatleast50years.
Work-relatedInjuryInsurance
Work-relatedInjuryInsurance(Work-relatedInjuryInsurance)isanimportantpartofthesocialinsurancesystem,whichreferstothestateandsocietyforworkersIntheeventofaccidentalinjury,occupationaldisease,deathcausedbythesetwoconditions,temporaryorpermanentincapacityoftheworkerinproductionandbusinessactivities,theworkerandhisrelativesshallbegivennecessarymedicaltreatment,livelihoodsecurity,economiccompensation,andmedicaltreatmentAsocialsecuritysystemformaterialassistancesuchasrehabilitation,socialrehabilitationandvocationalrehabilitation.
Afterawork-relatedinjuryoccurs,ifanemployeehasadisabilityaftertreatmentandtheinjuryisrelativelystable,whichaffectshisworkability,heshallconductagradedappraisalofthedegreeoflabordysfunctionandthedegreeofself-careobstacles,aswellastheappraisaloflaborabilityinaccordancewiththelaw.Amongthem,thelabordysfunctionisdividedintotenlevelsofdisability,theheaviestisthefirstlevel,andthelightestisthetenthlevel.Therearethreelevelsofobstaclestoself-careinlife:unabletotakecareofoneselfatallinlife,unabletotakecareofoneselfinmostoflife,andunabletotakecareofoneselfinpartoflife.Workerswithwork-relatedinjuriesshallenjoydifferentlevelsofwork-relatedinjurytreatmentinaccordancewiththedisabilityappraisalissuedbythelaborabilityappraisaldepartment.
Accordingtothe“WorkInjuryInsuranceRegulations”promulgatedbytheStateCouncilforthepaymentofworkinjuryinsurancepremiums,theamountofworkinjuryinsurancepremiumspaidbytheemployershallbetheproductofthetotalwagesoftheunit’semployeesmultipliedbytheunit’spremiumrate.Don'tpay.TakeBeijing'swork-relatedinjuryinsurancepaymentratioasanexample:companiespay0.2%-2%oftheirtotalpaymentbaseeverymonth,andindividualemployeesdonot.
TypesofCompensation
Work-relatedinjurycompensationmustgothroughthreenecessarystages:work-relatedinjuryidentification,work-abilityappraisal,andlaborarbitration.Manymigrantworkersdonothavelaborcontracts,workpermits,etc.,andtheyoftenneedtoidentifylaborrelations.
Medicalexpenses
1.Workerswhotreatwork-relatedinjuriesshouldseekmedicaltreatmentatthemedicalinstitutionthathassignedtheserviceagreement.Incaseofemergency,theycanfirstgotothenearestmedicalinstitutionforfirstaid.
2.Theexpensesrequiredforthetreatmentofwork-relatedinjuriesshallbepaidfromthework-relatedinjuryinsurancefundifitmeetsthework-relatedinjuryinsurancediagnosisandtreatmentitemlist,work-relatedinjuryinsurancedrugcatalogue,andwork-relatedinjuryinsurancehospitalizationservicestandards.
3.Workerswithwork-relatedinjurieswhotreatdiseasescausedbynon-work-relatedinjuries,donotenjoywork-relatedinjurymedicaltreatment,andshallbedealtwithinaccordancewiththebasicmedicalinsurancemethod.
4.Thefoodsubsidyfortheemployee’shospitalizationtreatmentofwork-relatedinjuries,aswellasthecertificationissuedbythemedicalinstitutionandtheapprovaloftheagency,thetransportation,boardingandlodgingexpensesforthework-injuredemployeestoseekmedicaltreatmentoutsidetheoverallplanningareashallbefromthework-relatedinjuryinsurancefundForpayment,thespecificstandardsforfundpaymentshallbestipulatedbythepeople'sgovernmentoftheoverallplanningarea.

1.Ifanemployeeisinjuredbyanaccidentatworkorhasanoccupationaldiseaseandneedstosuspendworktoreceivemedicaltreatmentforworkinjury,stopworkDuringthesalaryretentionperiod,theoriginalwagesandbenefitswillremainunchanged,andtheoriginalunitwillpaymonthly.
2.Theperiodofsuspensionofworkandpayisgenerallynotmorethan12months.Iftheinjuryisseriousorspecial,itmaybeappropriatelyextendedafterconfirmationbythelaborabilityappraisalcommitteeofthecitydividedintodistricts,buttheextensionshallnotexceed12months.

2.Workerswithwork-relatedinjurieswhohavebeenassessedfortheirdisabilitylevelandconfirmedbytheLaborAbilityAppraisalCommitteethattheyneedlivingcareshallbepaidmonthlyfromthework-relatedinjuryinsurancefund.

1.Aone-timedisabilitysubsidywillbepaidfromthework-relatedinjuryinsurancefundaccordingtothelevelofdisability,thestandardis:first-leveldisabilityis27Monthlysalary,thesecond-degreedisabilityis25months'salary,thethird-degreedisabilityis23months'salary,andthefourth-degreedisabilityis21months'salary.

1.Thefuneralsubsidyisthe6-monthaveragemonthlysalaryoftheemployeesintheoverallplanningareaofthepreviousyear;

1.Theone-timecompensationincludestheexpensesduringthetreatmentperiodoftheemployeesorchildlaborersinjuredbyaccidentsoroccupationaldiseasesandtheone-timecompensation.Theamountoftheone-timecompensationshouldbeinThedeathofanemployeeorchildlaborerwhowasinjuredbyanaccidentorsufferedfromanoccupationaldisease,orisdeterminedafterthelaborabilityappraisal.
2.Thelaborabilityappraisalshallbehandledbythemunicipallaborabilityappraisalcommitteewithdistrictsintheunit'slocationinaccordancewiththeterritorialprinciple.Thelaborcapacityappraisalfeeshallbepaidbytheunitwheretheinjuredordeademployeeorchildlaborerbelongs.
3.Livingexpenses,medicalexpenses,nursingexpenses,foodsubsidiesduringhospitalization,transportationexpensesandotherexpensesduringthetreatmentperiodforemployeesorchildlaborerswhoareinjuredbyaccidentsorsufferfromoccupationaldiseasesbeforethelaborabilityassessment,Inaccordancewiththestandardsandscopestipulatedinthe"WorkInjuryInsuranceRegulations",allpaymentsshallbemadebytheunitwherethedisabledemployeeorchildlaborerbelongs.
4.Thelump-sumcompensationforthedisabilityispaidaccordingtothefollowingstandards:thefirst-degreedisabilityis16timesthecompensationbase,thesecond-classdisabilityis14timesthecompensationbase,andthethird-degreedisabilityThecompensationbaseis12timesthecompensationbase,thefourth-degreedisabilityis10timesthecompensationbase,thefifth-degreedisabilityis8timesthecompensationbase,thesixth-degreedisabilityis6timesthecompensationbase,andtheseventh-degreedisabilityiscompensation.4timesthebase,theeighth-leveldisabilityis3timesthecompensationbase,theninth-leveldisabilityistwicethecompensationbase,andthetenth-leveldisabilityis1timesthecompensationbase.
5.Incaseofaccidentalinjuryoroccupationaldiseasecausingdeath,alump-sumcompensationshallbepaidat20timesthepercapitadisposableincomeofurbanresidentsnationwideinthepreviousyear,andinaccordancewiththepercapitadisposableincomeofurbanresidentsnationwideinthepreviousyearTentimesofincomewillbepaidinalumpsumofothercompensationsuchasfuneralsubsidies.
6.Thecompensationbasereferstotheaverageannualwagesofemployeesinthework-relatedinjuryinsurancecoordinatingareawheretheunitislocated.
Trafficaccident
AccordingtoArticle14ofthe"WorkInjuryInsuranceRegulations",thefollowingsituationsofemployeesshallbedeemedaswork-relatedinjuries:
1.Non-person’sprimaryresponsibilityfortrafficaccidentinjuries
Non-person’sprimaryresponsibilityreferstosituationsofequalresponsibility,secondaryresponsibility,andnoresponsibility;ifthepersonisinjuredduetotheprimaryresponsibilityandfullresponsibilityofthetrafficaccident,itmeansnoItisaworkinjury.
The"WorkInjuryInsuranceRegulations"promulgatedin2003stipulatethatinjuriesfrommotorvehicleaccidentsonthewaytoandfromgetoffworkconstituteworkinjuries,andthereisnolimitationofliability;the"WorkInjuryInsuranceRegulations"revisedin2010increasedthelimitationofliability,Thatis,itisnotthemainresponsibilityoftheperson(equal,secondary)thatconstitutesaworkinjury.
2.Workerswhoareinjuredbytrafficaccidentsduetoworkduringworkinghours
Workerswhoareinjuredbytrafficaccidentsatworkduringworkinghours,includingthosewhoaremotorvehicledrivers,areinjured.Italsoincludesinjuriestonon-driveremployees.
Othercircumstances
1.Disabilityallowances,dependentfamilypensions,andlivingcareexpensesshallbeadjustedbythelaborsecurityadministrativedepartmentoftheoverallplanningareainaccordancewithchangesintheaveragewageandlivingexpensesofemployees.Theadjustmentmethodsshallbeformulatedbythepeople'sgovernmentsofprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernment.
2.Ifanemployeehasanaccidentduringtheworktriporthewhereaboutsoftheemployeeisunknownduringemergencyrescueanddisasterrelief,thewageswillbepaidwithin3monthsfromthemonthoftheaccident,andthewageswillbesuspendedfromthefourthmonth,andtheworkinjuryinsurancewillbecovered.Thefundpaysdependentrelatives'pensionsonamonthlybasis.Ifyouhavedifficultiesinlife,youcanadvance50%oftheone-timeworkdeathallowance.Ifanemployeeisdeclareddeadbythepeople’scourt,itshallbedealtwithinaccordancewiththeprovisionsofArticle37oftheWorker’sInjuryInsuranceRegulationsondeathduetowork.
3.Workerswithwork-relatedinjurieswhohaveoneofthefollowingcircumstancesshallstopenjoyingwork-relatedinjuryinsurancebenefits:
(1)Losttheconditionsforenjoyingbenefits;
(2)Refusetoacceptlaborabilityappraisal;
(3)Refusetotreat;
(4)Sentenceisinprisonforexecution.
4.Iftheemployerissplit,merged,ortransferred,thesuccessorshallbeartheoriginalemployer’sworkinjuryinsuranceliability;iftheoriginalemployerhasalreadyparticipatedinworkinjuryinsurance,thesuccessorshallapplyforworkinjuryinsuranceatthelocalagencyChangeregistration.
5.Iftheemployerimplementscontractmanagement,theliabilityforwork-relatedinjuryinsuranceshallbebornebytheentitywheretheemployee'slaborrelationshipbelongs.
6.Ifanemployeeisinjuredbyawork-relatedaccidentduringthesecondmentperiod,theoriginalemployershallbeartheliabilityforwork-relatedinjuryinsurance,buttheoriginalemployerandthesecondeemayagreeoncompensationmethods.
7.Ifanenterprisegoesbankrupt,thework-relatedinjuryinsurancebenefitsthatshouldbepaidbytheunitinaccordancewiththelawshallbegivenpriorityduringthebankruptcyliquidation.
8.IfanemployeeisdispatchedtoworkabroadandshouldparticipateinlocalworkinjuryinsuranceaccordingtothelawsofthecountryorregiontoThework-relatedinjuryinsurancerelationshipdoesnotend.
9.Workerswhohaveawork-relatedinjuryagainandshouldbeentitledtodisabilityallowanceaccordingtoregulationsshallenjoydisabilityallowancetreatmentaccordingtothenewlyrecognizeddisabilitylevel.
10.Personalwagesrefertotheaveragemonthlywagesofemployeeswhosufferedinjuriesduetoworkaccidentsorsufferedoccupationaldiseasesinthe12monthsbeforetheysufferedoccupationaldiseases.Ifmysalaryishigherthan300%oftheaveragesalaryoftheemployeesintheoverallplanningarea,itshallbecalculatedas300%oftheaveragesalaryoftheemployeesintheoverallplanningarea;ifmysalaryislowerthan60%oftheaveragesalaryoftheemployeesintheoverallplanningarea,itshallbecalculatedat60%oftheaveragesalaryoftheemployeesintheoverallplanningarea.
